“The Third ‘Copyright Law’ Revision and Cultural Creative Industry Development Seminar” Successfully Held in SICIP

On May 30, 2020, The Third “Copyright Law” Revision and Cultural Creative Industry Development Seminar, organized by Shanghai International College of Intellectual Property of Tongji University and the National Intellectual Property Training (Shanghai) Base, and co-organized by BOSS & YOUNG Attorneys at Law, was successfully held in SICIP. Prof. Shan Xiaoguang, Prof. Li Mingde, Associate Professor Zhang Huaiyin, Associate Professor Hua Jie, Assistant Professor Wang Yukai from SICIP, and more than 100 scholars and experts from BOSS & YOUNG Attorneys at Law, Suning Co., Ltd., Hupu (Shanghai) Culture Communication Co., Ltd., Shanghai Online Game Association, Future Television Co., Ltd., Shanghai Microphone Culture Media Co., Ltd. attended this seminar.


Prof. Shan Xiaoguang, the Dean of SICIP, affirmed the importance of the seminar on the revision of the Copyright Law. He pointed out the extraction of problems from the industry, discussion of difficulties in the revision of the Copyright Law could make a meaningful contribution to the revision of the Copyright Law. He expressed gratitude to the attendance of experts and scholars.


Prof. Li Mingde gave a speech. He reviewed the history of the revision of the Copyright Law in China since 2011, introduced the background of the third revision of the Copyright Law, and described in detail his interpretation of the relevant provisions of the Copyright Law on audiovisual works, video products, broadcasting rights, etc.


In the section of sports industry, Mr. Guo Ninghui, the director of intellectual property Department of Suning, and Ms. Zhang Ni, the director of legal department of Hupu (Shanghai) Cultural Communication Co., Ltd., put forward their views on the revision of the copyright law based on their practical experience. Associate Professor Zhang Huaiyin, Associate Professor Yang Hong, and Mr. Chen Binyin expressed their views based on personal research and practical experience.


In the section of game industry, Mr. Han Shuai, the general secretary of the Shanghai Online Game Association, demonstrated the importance of copyright protection of live video games from the perspective of the development of the online game industry. Associate Professor Hua Jie described her research and opinions on copyright-related issues in online games and live game broadcasts. Lawyer Li Mao shared his specific views on the draft of the copyright amendment with practical cases.


In the section of audiovisual industry, Ms. Yang Xingfang, the Chief Legal Counsel and the General Manager of Intellectual Property and Legal Affairs Department of Future Television Co., Ltd., and Ms. Ye Juan, the Legal Manager of Shanghai Microphone Culture Media Co., Ltd. (Dragonfly FM) called for the revision of copyright laws in TV program review, punitive compensation, etc. Assistant Professor Wang Yukai combined with the newly passed "Civil Code" to interpret its relationship with the copyright law.


In the comment and questioning session, the attendees actively made speeches. Prof. Li Mingde and Associate Professor Hua Jie responded to the questions and gave a professional evaluation. Throughout the seminar, the scholars and experts spoke freely from their perspectives and contributed their insights to the revision of the Copyright Law. The seminar was welcomed by all the attendees.
